Below you will find our Purchase agreement. This agreement must be agreed to and signed at the time of pickup or 3 days before the kitten is due to fly with a flight nanny.

Under no circumstances will this cat/kitten be sold, leased or given to any pet shop, shelter, research laboratory, cloning laboratory or similar facility.

Under no circumstances will this cat/kitten be allowed to roam loose outdoors.

Buyer agrees to provide this cat/kitten a good and loving home. She/He will be kept up on all vaccines and buyer will make sure that all medical attention and treatment is given if necessary.

If at any time the buyer is not able to keep said cat/kitten, breeder must be contacted immediately. Breeder will take said cat/kitten back or assist buyer in placing said kitten/cat into an appropriate home.

Buyer agrees not to have this cat/kitten de-clawed, Unless all other options have been exhausted.

Over-vaccination is known to cause many auto-immune diseases and conditions in cats. The buyer will be supplied with a list of vaccinations that have been administered to the kitten. Do NOT allow your vet to repeat any of the vaccinations that have already been given by the breeder. If your kitten is re-vaccinated, this will void this contract. Do NOT allow your vet to give multiple vaccinations at any time during a vet visit. you must be an advocate for your kitten!

If buyer or breeder commences any legal action as a result of this contract, buyer agrees that the place of venue shall remain in the County of Marion in the State of Iowa. This contract is a legal and binding agreement between the two parties (buyer and breeder) and is NOT transferable.

Breeder guarantees the health as stated below.
Health Guarantee
The Breeder guarantees that before the Buyer takes possession of the kitten, it will be examined by a veterinarian (usually 11 weeks of age) and deemed in good health. Said kitten is guaranteed to be in good health at the time of pick up, delivery, or shipment (before shipment.)
72-Hour Guarantee
The Breeder gives a 72-hour health guarantee against life-threatening illnesses. The Buyer is encouraged to take the kitten to a licensed veterinarian to have it examined (at Buyer’s expense) within 72 hours (3 business days) or this guarantee is void. If the kitten is found to have a pre-existing and life-threatening problem, the Buyer must notify the Breeder at once (within the 72 hour period) with the following information:
1. Name, address, and phone number of the licensed veterinarian who examined the kitten.
2. The diagnosis and all medical records.
3. If the kitten dies in the Buyer’s care, proof of death is required (autopsy if needed).
The Buyer needs to make arrangements to return the kitten to the Breeder (at Buyer’s cost) within 48 hours from the date of diagnosis with the requested information. The Breeder will then take the kitten to their veterinarian and if the same life-threatening illness is confirmed or death occurs as a result of a life-threatening illness, the Buyer is eligible for one of the following two options:
Option 1: A refund of the paid price of your kitten with the return of the original kitten within 48 hours of examination. This excludes all delivery/shipping costs.
OR
Option 2: A replacement kitten from the next available litter (delivery/shipping costs not included) with the return of the original kitten within 48 hours of examination.
If it is found by the breeders veterinarian that the kitten does not have a life-threatening illness, the Buyer may take the kitten back and pay all related veterinarian costs. If the Buyer declines to take the kitten back, no refund will be given.
Seller does not guarantee against treatable nuisances (such as fungus, yeast, parasites, ear mites, respiratory infections, coccidia, giardia, etc) which are not life threatening and are treatable. Kutabays Cattery has taken every precaution to avoid these issues.
In no way are we against vaccinating and protecting your kitten from potential health hazards, however, it is agreed by both Buyer and Breeder that this Health Guarantee is null and void if the buyer has the kitten vaccinated for FELV (Feline Leukemia) or FIP (feline infectious peritonitis). Besides endangering the life of your kitten these vaccines are very stressful to the immune system of a young kitten and are not necessary for the continued health of an indoor-only cat who doesn't have repeated contact with other cats. FELV, Feline leukemia, IS a contact disease. Only through the contact with an infected cat can this be transmitted. While the Feline Leukemia vaccine is relatively safe, it has a minimum protection rate of only 80%. The FIP vaccine is highly controversial and it has proven ineffective against most strains of the corona viruses associated with the disease. No one knows much about FIP or how it is transmitted. Speculation is that it is an immune system defect. Kittens do not build a lasting immunity to this virus and the vaccine may actually cause your cat to contract the virus. The tests for FIP are highly unreliable and can only, at best, verify exposure to a virus of this type, not necessarily FIP. The FIP test must be repeated several times, as an exposed cat can shed the virus, but never become ill. Keeping your kitten away from others and indoors at all times, is your best guarantee for avoiding exposure. If you and/or your Veterinarian decide to give either of these vaccines, the breeder shall not be held responsible in any way.
Buyer Agrees and understands that Seller does not guarantee this cat/kitten for FIP (feline infectious peritonitis). No refund or replacement will be given. Kutabays Cattery has taken every precaution to avoid this issue but because of the nature of this virus it cannot be guaranteed.
Buyer agrees to assume all responsibility for veterinarian expenses once the kitten leaves the possession of the breeder.
24 Month Guarantee
The Breeder agrees to a 2-year (24 month) health guarantee which covers any life threatening genetic diseases. The Breeder requires all medical proof (X-rays, blood work, records, etc) of this diagnosis from the Buyer’s certified veterinarian to validate the claims of the disabling genetic disease. In addition, the documented evidence should include a statement by the Buyer’s certified veterinarian that the defect is unquestionably a hereditary defect that could not have been, in any way, caused by environmental or other factors. The Buyer must get the approval of the Breeder before any surgery or treatments are to be done, otherwise this guarantee is void. All veterinary records must include said kittens Microchip Number that has been verified by the veterinarian. Buyer understands the Breeder has the right to a second opinion.
NOTE: If the cat is re-homed, euthanized or disposed of in any other way, without the Breeder’s consent or a second opinion from the Breeder’s veterinarian, the Buyer has voided this guarantee. A voided guarantee means the Buyer is no longer eligible to receive a replacement kitten or financial compensation.
The Breeder agrees that should the life threatening genetic diagnosis be confirmed, then the Buyer is eligible for one of the following options:
Option 1: The breeder will refund up to 50% of the purchase price of the kitten (not including shipping costs) for treatment reimbursement. The Buyer will provide proof of veterinary expenses and a copy of the paid invoice before reimbursement is provided.
OR
Option 2: The Breeder offers a replacement kitten of the breeders choice from the next available litter. The Buyer is not required to return the original cat in this situation.
If the cat is overweight, underweight or neglected, this guarantee becomes void. The Breeder will not be held responsible for the illness or death of any cat which is found injured due to neglect, malnourishment, dehydration, accident related, or abused; that could have been prevented and treated by the cat's owner.
Extended Guarantee
We offer an extended guarantee of an additional 2 years (24 months) for a total of 4 years (48 months) if the buyer continues to feed said kitten/cat Life’s Abundance All Life Stages Cat Food for the full duration of the guarantee. Nutrition is a main component to good health so it is important to feed a high quality, proven food and we feel Life’s Abundance provides that. To qualify for the Extended Guarantee, the buyer must purchase an adequate amount of Life’s Abundance food through https://lifesabundance.com/kutabays so Kutabays Cattery has record of the food purchased.
Please note that during times of stress, such as going to a new home, cats can exhibit temporary signs of illness which may include: sneezing, runny nose, watery eyes, diarrhea and /or constipation. To help reduces the signs of stress, feed the cat/kitten identical food as the breeder and offer bottled water, as well as taking reasonable measures to reduce stress. You can do this by slowly introducing them to the house and the members of the household, as well as limiting the time they are with strangers, children and other animals.
